Data protection declaration

(Privacy Policy)

Foreword

mo2drive takes data protection seriously. Special attention to privacy when processing personal data is an important concern for us.

The data is used in accordance with the provisions of European data protection law. mo2drive is responsible for the data collection and data processing on this website in terms of data protection law and undertakes to maintain confidentiality.

In addition to mo2drive GmbH, the cooperation partners are also jointly responsible under data protection law for some of the data processing mentioned below. Some rights can also be exercised directly vis-à-vis these co-operation partners. Corresponding information is noted at the relevant point.

1. Personal data

While booking with mo2drive, when filling out the booking form and when contacting the mo2drive team, personal data is requested and stored. Personal data is information that can be assigned to individual customers. This includes, for example, name, date of birth, postal address, e-mail address and mobile phone number as well as vehicle usage data. This information and any other voluntary details are collected and stored by mo2drive and used for the purposes specified or resulting from the enquiry or service. mo2drive may also use customer data for product surveys, marketing and sending newsletters on its own behalf, whereby there is an option to unsubscribe in each case. Personal data may be transferred to state institutions and authorities within the framework of mandatory national legislation.

2. Use of external service providers / disclosure of customer data to third parties

External service providers commissioned by mo2drive also process personal data in accordance with the requirements described above and may not use it for their own purposes.

Data will only be passed on to third parties if this is permitted or required under European data protection law. This is the case on the one hand if the customer has expressly consented to the transfer of data to one of our co-operation partners or if the transfer is necessary for the execution of the contract (e.g. towing service, vehicle service). Disclosure is also permitted under data protection law if the enforcement of regulations of other laws (e.g. criminal law regulations) requires the disclosure and there is nothing to prevent this disclosure from a data protection perspective.

3. Security measures for data protection

mo2drive has taken technical and organizational measures for data protection. These are continuously adapted to ensure that they are always up to date against manipulation of any kind. The transmission of personal data between the end devices and our server is always encrypted.

4. Use of cookies

We use cookies – small files with configuration information – for our website. They help to determine individual user settings and to realize special user functions. We do not collect any personal data via cookies. In this respect, these cookies cannot be assigned to a specific person. All functions of the website can also be used without cookies. However, some features and settings will then not be available. If no information about the visit to our pages is to be collected or analyzed, this must be set by the user using the opt-out function of the browser used.

5. Right of cancellation and deletion

If customers have provided us with personal data, this can be updated and changed at any time upon request to office@mo2drive.com. For a complete deletion of the master data, customers can contact office@mo2drive.com.

However, deletion is only possible for data that is not required for processing the contractual relationship or for legally prescribed archiving purposes or for evidence purposes.

6. Links to other websites

Our online offer may contain links to other websites to which this privacy policy does not apply. We also have no influence on whether their operators comply with data protection regulations.

7. Questions, comments and requests for information

Every customer has the right to receive information about the personal data stored by mo2drive at any time.

Please send questions and suggestions on the subject of data protection and requests for information on stored data by e-mail to office@mo2drive.com.

8. Amendment of the data protection information

We reserve the right to occasionally adapt parts of this privacy policy that do not require consent so that they always comply with current legal requirements or to implement changes to our services in the privacy policy, e.g. when introducing new services. The new privacy policy will then apply when you visit our website again. If prior consent is required for a change to our services or for the introduction of a new service, we will inform our customers accordingly in good time and ask for their consent.

9. Out-of-court dispute resolution

mo2drive GmbH does not participate in dispute resolution proceedings before consumer arbitration boards.

Use of Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc (“Google”). Google Analytics uses so-called “cookies”, text files that are stored on the user’s computer and enable the use of the website to be analyzed. The information generated by cookies about the use of this website by customers (including IP addresses) is transmitted to a Google server in the USA and stored there. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate the user’s IP address with any other data held by Google. Users can prevent the installation of cookies by selecting the appropriate settings in their browser software. However, we would like to point out that in this case users may not be able to use all functions of this website to their full extent. By using this website, users consent to the processing of the data collected by Google in the manner and for the purposes described above.

Use of Facebook plugins

This website uses plugins from the social network facebook.com, which is operated by Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). When users access web pages on our website that contain such a plugin, a connection to the Facebook servers is established and the plugin is displayed on the website by notifying the browser. This tells the Facebook server which of our web pages the user has visited. If the user is logged in to Facebook as a member, Facebook assigns this information to the personal Facebook user account. When using the plugin functions (e.g. clicking the “Like” button, posting a comment), this information is also assigned to the Facebook account, which can only be prevented by logging out before using the plugin. Users can find more information on the collection and use of data by Facebook, their rights in this regard and options for protecting their privacy in Facebook’s privacy policy
